Please read these Terms of Service (“Terms”) carefully before using ImageChunker (“the App”). By downloading, installing, or using ImageChunker, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

Download and install ImageChunker on Apple devices you own or control
Use ImageChunker for personal or commercial purposes
Create and export chunked images for any lawful purpose

This license is granted through the Mac App Store and is subject to Apple’s Standard License Agreement.

2. Restrictions

You agree NOT to:

Reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works of the App
Remove or alter any proprietary notices or labels
Use the App to process illegal, harmful, or infringing content
Redistribute, sublicense, or resell the App
Use automated systems to access the App in ways that exceed reasonable personal use

3. Intellectual Property

Our Rights

ImageChunker, including its code, design, logo, and documentation, is protected by copyright and other intellectual property laws. All rights not expressly granted are reserved.

Your Content

You retain all rights to images you process with ImageChunker. We claim no ownership or license to your images or the output chunks.

4. User Responsibilities

You are responsible for:

Ensuring you have rights to process the images you use
Complying with applicable laws regarding your content
Maintaining backups of your original images
Using the App in accordance with these Terms

5. Disclaimer of Warranties

ImageChunker is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness of results

We do not warrant that:

The App will meet your specific requirements
The App will be uninterrupted, timely, secure, or error-free
Results obtained from the App will be accurate or reliable
Defects will be corrected

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Damages resulting from unauthorized access to or use of the App
Damages resulting from any bugs, errors, or interruptions in the App

Our total liability for any claims arising from your use of ImageChunker shall not exceed the amount you paid for the App.

7. App Store Terms

Your use of ImageChunker is also governed by:

Apple’s Mac App Store Terms of Service
Apple’s Standard End User License Agreement (EULA)

In case of conflict between these Terms and Apple’s terms, Apple’s terms shall prevail for App Store-related matters.

8. Updates and Modifications

We may:

Release updates to improve functionality, fix bugs, or address security issues
Modify features or functionality at any time
Discontinue the App or any features with reasonable notice

Updates may be delivered automatically through the Mac App Store. We recommend keeping automatic updates enabled for security and stability.

9. Support

Support is provided at our discretion and may include:

Email support for bug reports and questions
Documentation and guides on our website
Community resources

We are not obligated to provide support services and may limit or discontinue support at any time.

10. Termination

We may terminate or suspend your license immediately if you:

Violate any provision of these Terms
Engage in fraudulent or illegal activity
Attempt to harm the App or other users

Upon termination, you must stop using the App and delete all copies.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or your use of ImageChunker shall be resolved through:

Good Faith Negotiation: We will first attempt to resolve disputes informally
Binding Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration

You agree to waive any right to participate in class action lawsuits or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any Apple agreements, constitute the entire agreement between you and us regarding ImageChunker.

15. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through:

Updated date at the top of this page
In-app notification (for significant changes)
Announcement on our website

Continued use of ImageChunker after changes constitutes acceptance of the updated Terms.
